Any order of products implies the unconditional adherence to these general conditions of sale, supplemented or arranged by our special conditions, which cancel any clause to the contrary that may appear in the conditions of purchase, purchase orders, or other trade documents.

Price

The goods are invoiced at the rate in effect on the day the order is placed. The general rate is attached to these conditions. Prices may be revised subject to prior notice of 30 days.

NOTICES AND COMMUNICATIONS

Delivery

Delivery shall be effected either by direct delivery of the product to the purchaser, or by notice of supply, or by delivery to a consignor or to a carrier at the seller’s premises or at any other designated premises. The verification of the goods by the buyer must be carried out at the time they are taken over. In the event of damage or shortage, claims on apparent defects or non-conformity of the delivered product, the buyer will issue clear and precise reservations which he will notify within three days, following the date of delivery in writing to the seller or carrier. It will be up to the buyer to provide any justification as to the reality of the anomalies found. Products ordered in pre-order will be delivered within 3 weeks/ one month. If the delay happens to be longer, the seller must inform the buyer who can withdraw his sale and get a refund if he wishes.

Delivery times

Delivery times are indicated according to supply availability. Except in cases of force majeure (war, riot, fire, total or partial strike.), in case of delivery delay of a duration greater thanOLICY
Personal data may be gathered on the site and used by Emma Bruschi which acts as data controller within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and the free movement of such data and repealing Directive 95/46/EC (hereinafter “General Data Protection Regulation” or “GPDR”). Emma Bruschi is obliged to ensure the security and confidentiality of its customers’ personal data in accordance with the GDPR. Customers’ personal data (surname, first name, postal address, telephone number, email address) may be disclosed to Emma Bruschi service providers and partners, should their involvement be necessary in the processing and management of orders. These service providers and partners can only act on instructions from Emma Bruschi. The purposes of the collection of personal data are detailed below: Processing of Customer orders (delivery, return, refund) / Data relating to an order that has been placed will be transmitted to our banking service provider while payment is being made for validation of the payment. / If the Customer has ticked the box to subscribe to the Emma Bruschi Newsletter, he/she expresses his/her consent to receiving the brand’s marketing communications. / In accordance with the GDPR, the Customer has a right of access, rectification and opposition to the personal data concerning him/her (hereinafter referred to as the “Data Protection Rights”).

Guarantee

The seller will bring the utmost care to the execution of the order and the quality of the products. In the event of a defect recognized by the seller, the seller’s obligation shall be limited to the replacement or refund of the defective quantities, without further compensation. The warranty does not cover defects and damage resulting from storage, handling, transport or use under conditions abnormal or not in accordance with the nature, requirements and suitability for use of the product. If the product is damaged by wear, the buyer has the possibility to have his part repaired by sending an email to the company to agree on the conditions. Shipping costs are the responsibility of the buyer.

Payment

Except under special conditions, invoices are payable upon order. In case of late payment, the seller can suspend all orders in progress. Any sum not paid by the due date shown on the invoice automatically entails the application of penalties equal to once and a half the legal interest. These penalties will be payable on request of the seller. No discount is accepted for advance payment.

Termination clause

In the event of non-payment, forty-eight hours after an unsuccessful formal notice, the sale will be terminated by operation of law by the seller, who may request the return of the products without prejudice to any other damages. Amounts outstanding for other deliveries
become immediately payable if the seller does not opt for the resolution of the corresponding orders.

Retention of title

The goods sold remain the property of the seller until the full payment of their price. However, the risks associated with the goods will be
transferred to the buyer or the carrier, as soon as the products are physically delivered.
